TERMS OF PROPERTY SHOWING MANDATE AGREEMENT

  1. In the event of the conclusion of a preliminary agreement or final contract for the purchase, exchange, or lease of the aforementioned property as a result of the mediation of Ilias Fragkakis, I hereby undertake and commit to paying him a brokerage commission amounting to {{fee}}. This amount shall be subject to the applicable VAT as required by law. The aforementioned commission is deemed by me to be fair, reasonable, and proportionate to the brokerage efforts and negotiation services required for this agreement. Consequently, I explicitly declare that there is no basis for any reduction of this fee. Furthermore, I acknowledge that I am obligated to pay this commission to the broker even if I was already aware of the counterparty or the property introduced. To this end, I am required to immediately inform the broker of any properties I was previously aware of.
  2. Likewise, if a preliminary agreement or final contract for the purchase, exchange, or lease is concluded as a result of the mediation of Ilias Fragkakis with any of my relatives, regardless of the degree of relation, my business partner (whether an individual or a legal entity), a company of my economic interest, or any person I indicate, on whose behalf I explicitly declare that I sign this mandate, I undertake and commit to paying him, jointly and severally with the aforementioned persons or entities, the same brokerage commission as specified above, irrespective of whether the same property was subsequently introduced by another real estate broker after the signing of this agreement.
  3. I, as well as the aforementioned individuals or legal entities on whose behalf I am acting, undertake and commit to paying the agreed brokerage fee in full at the time of signing the final purchase/exchange/lease contract. If a preliminary agreement is signed, the brokerage fee shall be paid upon its execution.
  4. The broker is not responsible for the accuracy of the information provided by the property owner, provided that such information has been verified with due diligence. The client acknowledges that the final responsibility for verifying the legal and factual characteristics of the property lies with them.
  5. This brokerage agreement is governed by the provisions of Law 4072/11-4-2012, as well as Articles 703 et seq. of the Greek Civil Code (ΑΚ) and Presidential Decree 248/1993.

 

  1. If I enter into direct negotiations with the sellers of the aforementioned properties and ultimately proceed with the purchase, exchange, lease, or any other transaction involving any property that was introduced to me by them or any property owned by them, I explicitly acknowledge and undertake to pay the brokerage commission to Ilias Fragkakis, as specified in Clause 2, regardless of whether the specific property is referenced in this agreement. In such a case, I recognize and accept that my decision to proceed with the transaction is a direct result of the broker’s mediation and introduction.
  2. The parties expressly agree that any disputes arising from the interpretation or execution of this contract shall be subject to the exclusive jurisdiction of the Courts of Athens, Greece.
  3. No modification of this agreement shall be valid unless made in writing.
  4. This agreement is valid both in physical and electronic form. Acceptance of its terms may be expressed in any of the following ways: a) By the physical signature of the parties, b) By signing via tablet or other digital device and sending the signed document via email and c) By sending an email from the client with a clear statement that they accept the terms of the agreement.

Acceptance via email constitutes a legally binding contractual declaration, in accordance with Article 160 of the Greek Civil Code and Regulation (EU) 910/2014.

The personal data collected under this agreement will be used exclusively for the execution of the contract and the fulfillment of the obligations arising from it. This data will not be disclosed to third parties without the express consent of the client, in accordance with the General Data Protection Regulation (EU Regulation 2016/679).

To confirm the above terms, this private brokerage agreement has been drafted and, after being read, is signed as follows, with each party receiving an identical copy.
